Present - Peg Arguimbau Chairman, and Commission Member Katherine Roth.
No Quorum

7:45 p.m.:  N.O.I. Hearing Continuance - A.G.M. Inc.  Proposed site preparation for the construction of a single-family residence at Lot 1 Chippewa Road. DEP FILE # SE-280-460:

Peg opened the meeting. Joe DiSipio, the Builder representing A.G.M., was present.
Peg reviewed the Commission's concerns that were discussed at a previous meeting held with the Applicant regarding the proposed project:
Peg inquired as to the type of equipment proposed to access the lawn area in the back portion of the property at the edge of the 100' Buffer Zone.
Joe replied that plywood planks would be used for a backhoe machine to achieve access over the lawn area of the proposed site.
Peg inquired if the haybale line marked on the revised plan dated 10/5/04 defines the limit of work area.
Joe DiSipio replied that he was not certain if the haybale line marked on the proposed plan indicates the limit of work area.
Greg stated that the installation of haybales indicating the usable area on the lot should be at least 50' from the 100' Buffer line. Greg suggested that the installation of roof leaders and a dry well be considered for the proposed project in an effort to prevent the excess roof water runoff from
negatively impacting the vernal pool on the site.
Peg stated that the Applicant could start the work proposed outside of the 100' Buffer Zone provided
that the boundaries of the existing Conservation Restriction Line on the property are delineated with orange painted 3' pipes.
Joe DiSipio agreed that the Hearing be continued until November 4, 2004 at 7:45 p.m.

8:10 p.m., Jim Miller Engineer, from Miller Engineering was present to discuss
                the proposed site preparation for construction of a single-family residence at                  Lot 1 Chippewa Road. DEP FILE # SE-280-460:

Peg discussed with Jim Miller the meeting previously held this evening with Joe DiSipio regarding the proposed project.
Peg asked Jim Miller if the haybale line marked on the revised plan dated 10/05/04 defines the limit of work area.
Jim Miller confirmed that the haybale line on the proposed plan indicates the limit of work area.
Peg inquired, in terms of the grade work, what the total amount of lawn area is proposed in the rear of the property after the haybales are removed.
Jim proposes to utilize as much lawn area as possible, extending up to the Conservation Restriction Line.
Peg stated that the allowable lawn area would be the outer 25' from the 100' Buffer Line where it intersects with the Conservation Restriction Line.
Peg suggested that Jim submit some new line proposals regarding the lawn area for the Commission to review at their next meeting.
Katherine Roth expressed her concern of the lawn area in the rear of the property being further extended by future lawn extensions and suggested that plantings be installed along the existing Conservation Restriction Line.
Peg recommended that a row of highbush blueberry and sweet pepper-bush shrubs be installed along the edge of the 100' Buffer Line.  
Jim Miller agreed to meet again with the Commission on November 4, 2004 at 7:45 p.m.

Mansfield Street & Massasoit Road Subdivision Plan
Jim Miller presented a conceptual subdivision plan by A.G.A.  dated 10/13/04, Mansfield Street and Massasoit Road.
Jim stated that several years ago the Planning Board approved the subdivision plan.
When the subdivision plan was approved the Conservation Restrictions that were placed on two of the lots were supposed to be deeded to the Town; however, the lots are still in A.G.A,'s name.
Jim stated that a resident by the name of Kowalski contacted the A.G.A. regarding the possibility of creating another buildable lot. (The resident owns the parcel from Mansfield Street to Knob Hill Road.)
Jim stated that a buildable lot could be constructed by combining the three lots, however, frontage would be on a Private Way due to an existing brook located on the other side of the lot.
(54,000' of contiguous high and dry is the Planning Board's requirement.)
Jim requested discussing with the Commission the renegotiation of the land transfer.
Jim stated that the Planning Board's approval would be necessary for creating the other buildable lot with the frontage proposed on a Private Way.
As the land transfer was part of the covenant with the Planning Board for the approved subdivision, Peter O'Cain previously advised Jim that if the Commission were in agreement regarding the proposed plan, it would be necessary for the Applicant to request the Planning Board to reopen the Public Hearing to
modify the approval.
Jim proposed the following Conservation Restrictions regarding the two lots:
Lot 2
     A Conservation Restriction requirement of approximately 55,273 sq.ft. on the east of the brook on the site.
Lot 3
    A Conservation Restriction requirement of approximately 48,646 sq.ft.

The combined Conservation Restriction that is proposed for lots 2 & 3 is 103,919 sq.ft.
(Approximately 2.4 acres.)  
Jim Miller agreed to meet again with the Commission on November 4, 2004.

8:30 p.m., N.O.I. Public Hearing filed by David Wluka. Proposed replacement of an existing retaining  wall on the shore of Lake Massapoag adjacent to 64 Massapoag Ave. DEP File # SE-280-461:

Present - Peg Arguimbau Chairman, and Commission Member Katherine Roth. Dr. Fred Martin was present in the audience.
Peg opened the Hearing with David and Nancy Wluka present. Dana Clow Engineer, from Advance Concepts was also present.
Dana Clow submitted the green abutter cards.
Dana Clow presented photographs showing the present condition of the existing retaining wall and explained that the existing structure is a concrete wall comprised of rocks and rubble with a timber retaining wall constructed on top of the concrete wall foundation. Both the concrete wall and timber retaining wall are rotating outward and are in a failed condition. The proposed project is within the existing footprint.
Dana Clow explained the proposed project:
Reconstruction of the concrete retaining wall to provide support to the existing 12' x 30' deck.
The depth of the existing retaining wall is not known at this time.  
The deck would temporarily be raised or moved back and supported without interfering with the roadway, or the deck may be moved across the street during the reconstruction.
     The deck is not proposed to be rebuilt, just the structure supporting the deck.
Plas-Crete interlocking wall blocks 24"x24"x48" and conventional fill is the material proposed for the project. A crushed stone base for stabilization control is proposed underneath the blocks.
     The frame for the retaining wall would remain at the same elevation. This would bring the ground grade up to 10" below the level of the deck.

(Granite blocks may also be considered for the proposed project)
Two granite steps are proposed to be installed for the new retaining wall.
Dana Clow stated that a biodegradable silt fence is proposed for erosion control.
Peg inquired as to how the construction debris is proposed to be excavated from the site.
Dana Clow replied that the rocks and rubble from the construction site would be broken up and removed by an excavation machine.
There is no proposed clearing of trees or vegetation removal for the proposed project.
Peg requested that the Applicant submit to the Commission a stabilization control plan to prevent the soil from washing off the site from the proposed construction equipment.
The Applicant agreed to continue the Hearing until November 4, 2004 at 8:00 p.m.
